In order to hold a wedding ceremony, you must first have a marriage license. There are many rules and regulations regarding marriage licenses that differ from state to state. These laws are easy to understand; it is simply a matter of calling ahead and finding out what you will need to do in your particular area. The list below highlights a few common laws concerning marriage licenses:

  • You should begin by calling your local marriage license bureau, or the marriage bureau in the state you plan to be married in. In Houston, you need to contact the County Clerk’s office. Several are listed below.

  • Both you and your fiancé must go to the County Clerk’s office in person. If you are under the age of 18, then your parents must accompany you. They need to show proof of identification and they will be asked to give their written consent.

  • If you have been married before, you must provide proof of divorce or an annulment. You must be divorced for 30 days before you can remarry, unless you have a waiver in the divorce decree from a judge.

  • The license is usually issued the day the application is made, but some restrictions may apply. For example, some counties offer a marriage license solely for that specific county, meaning that your license would not be valid anywhere else in that state. A license issued in Harris County is good in every county in the state of Texas.

  • After you receive your license, you must wait three days before you may be married. In certain situations, such as active military duty, a Judge may issue a special document that would waive the three-day waiting period. If your fiance' is in the Military, the 72 hour waiting period is automatically waived with proof of military ID.

  • In Harris County, a license is valid for 30 days and costs $41.
    WHERE DO I GO TO GET A MARRIAGE LICENSE? A marriage license may be purchased at the Harris County Clerk's Office between 8:00 a.m. and 4:30 p.m., Monday through Friday. The main office is located in downtown Houston, and there are nine other branch locations in the greater Houston area:
